1. Introduction
These terms and conditions set out the rules and conditions for using the Atelier Colors website, available at ateliercolors.at.
By using this website you confirm that you accept these terms and conditions. If you do not agree with any part of them, please do not use the Atelier Colors website.
In these terms, "customer", "you" and "your" refer to the person visiting or using the website. "Atelier Colors", "we", "us" and "our" refer to the operator of this website and the provider of the relevant products and services.
Words used in the singular or plural, or in different grammatical forms, carry the same meaning unless the context requires otherwise.
2. Right of withdrawal within 14 days
If you are a consumer, you have the right to withdraw from the purchase contract within 14 days of receiving the goods, without giving a reason. The deadline is met if you send your notice of withdrawal before the period expires.
To withdraw, simply email us at info@ateliercolors.at or use the model withdrawal form set out in our Returns and Refunds Policy. We will confirm receipt without delay.
Send the goods back to us no later than 14 days after withdrawing, to Hirschtettner Straße 19, 1220 Vienna, Austria. YOU BEAR THE COST OF RETURNING THE GOODS.
We will refund all payments received no later than 14 days after we receive your notice of withdrawal, using the same means of payment you used, unless we agree otherwise. We may withhold the refund until we receive the goods back, or until you supply evidence that you have sent them.
We also refund the delivery costs you paid, up to the amount of the cheapest delivery method we offer. If you chose a more expensive method, the difference is not refunded.
YOU MAY UNPACK AND INSPECT THE GOODS to the extent you would in a physical shop. Opening the package does not by itself cancel your right of withdrawal. However, if the goods lose value through handling beyond what is necessary to establish their nature and characteristics, we may reduce the refund accordingly; we will always tell you in advance and explain why.
The right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons once the seal has been broken.
This statutory right applies alongside our voluntary 45-day return window described below. You may use whichever suits you better.
3. Returns and refunds
A product purchased from Atelier Colors may be returned within 45 days of the date of purchase, unless the law provides otherwise.
The returned product must be in the same condition as it was delivered, and where possible in its original packaging. Please contact us using the details on the website before sending anything back.
The costs of returning goods and who bears them are governed by applicable law and by the specific terms of the purchase.
Where a product has not been delivered, a refund may be issued in line with the delivery terms and applicable law. If your product did not arrive, contact us so we can look into it.

4. Cookies
The Atelier Colors website uses only cookies that are technically necessary for it to work — in particular to keep your shopping cart and, if you are signed in, your account session. These strictly necessary cookies do not require consent.
We do not use analytics, advertising or other tracking cookies, and no third-party partners set cookies for those purposes. If this ever changes, we will update this section and our privacy policy before doing so.
5. Licence and intellectual property
Unless stated otherwise, all content on the Atelier Colors website — including text, photographs, graphics, logos, design, databases, video and other material — is protected by law and belongs to Atelier Colors or its licensors.
All rights to this content are reserved.
You may use the content of the website only for personal, non-commercial purposes and in accordance with these terms.
Without our prior written consent you may not, in particular:
- republish the website content;
- sell, rent or sub-licence the website content;
- reproduce, copy or duplicate the website content;
- redistribute the website content;
- use Atelier Colors material in a way that could damage its rights or legitimate interests.
6. Linking to our website

Atelier Colors is not responsible for the content of third-party websites that our website may link to.
No link to another site should be placed on pages containing unlawful, defamatory, obscene or otherwise objectionable content, or which infringe third-party rights.
Atelier Colors reserves the right to request removal of a link to our website where this is justified.

10. Reservation of rights and changes to these terms
Atelier Colors reserves the right to request removal of any link to our website. On our request you must remove such a link without undue delay.
Atelier Colors also reserves the right to amend or update these terms at any time. The current version will be published on this website.
By continuing to use the website after changes are made, you accept the updated terms to the extent such acceptance is required by applicable law.
If you find any link on our website inappropriate or problematic for any reason, you may tell us using the contact details on the website. We may consider each such request, but we are not obliged to accept every one.
Atelier Colors does not warrant that all information published on this website is at all times fully up to date, complete or free of error. We also do not warrant uninterrupted availability of the website.
11. Limitation of liability
To the extent permitted by applicable law, Atelier Colors excludes or limits liability for use of this website and its content.

- limit liability in a way not permitted by applicable law;
- exclude liability which cannot be excluded under applicable law.
Any limitation of liability in these terms applies only to the extent permitted by applicable law.
Where the website and its content are provided free of charge, Atelier Colors is not liable for loss or damage arising from their use, to the extent permitted by applicable law.

The seller is not registered for VAT — the small business scheme under § 6 Abs 1 Z 27 of the Austrian VAT Act (UStG) applies. Prices shown are final; no VAT is charged.
13. Alternative dispute resolution
We are not obliged and have not committed to participate in alternative dispute resolution proceedings before a consumer arbitration board. If a dispute cannot be resolved directly between us, we will inform the consumer, as required by § 19 Abs 3 AStG, about the competent dispute resolution bodies (Internet Ombudsstelle, www.ombudsstelle.at; Schlichtung für Verbrauchergeschäfte, www.verbraucherschlichtung.at) and whether we will take part in such proceedings. We prefer to settle matters directly — get in touch and we will do our best to resolve it.
